GENERAL TERMS OF SALE

1. Object

These terms and conditions determine the rights and obligations of the company i.Management and the buyer as part of the sale of goods by the company i.Management on its website and / or outside of it.
In the case of sale on its website and in the case of a distance contract in electronic mode, i.Management company intends to identify themselves to the buyer as follows:

2. THE OFFERS AND THE PRICES

All the offers of products proposed on the site are limited to territories defined in SHIPPING & RETURNS.
The contract is proposed in the French and English language. i. Management excludes any responsibility in case of misunderstanding by a buyer who would not have sufficient understanding of either language.
The offer is made for a limited duration. It is advisable to the buyer to pay attention on the limit of validity of the offer of time as stated on the website www.myskeenpatch.com
Prices are listed in the online order form. They are indicated in euros exclusive flat fee for postage.
Shipping costs include preparation and packing fees as well as postage costs. They are fixed for each box ordered.

3. ORDERS AND PAYMENTS

– Double check the medical counterindications, accept the general terms of sale and accept the order

– For credit card payments: you will receive a confirmation of the payment by email

The order is validated only with the confirmation of the payment:
– By credit card when the banking platform returns the validation message of the transaction,
– By check, postal order or international money when documents are received by i. Management,
– By bank transfer when the information is brought to the attention of i. Management by his bank.

4. ACCEPTED MODES OF PAYMENT

The buyer agrees to pay the cost of products purchased and any surplus charges (including all taxes and surcharges at the legal rate of interest in case of delay, if any) which may be incurred under its purchases or as a result of non-action on the buyer’s part.

To this effect, the buyer has in his choice the following possibilities of payment:

> By credit card (secured payment).

i.MANAGEMENT uses ecommerce solution Caisse Régionale bank Credit Agricole Sud Méditerranée.
The buyer is thus ensured the protection of his transactions. Banking information provided upon confirmation of an order will never transmit unencrypted data over the Internet, thus avoiding any risk of piracy. Data encryption is performed by 128-bit, the highest level of encryption allowed.
I. Management specifies that the payment is directly made on the banking platform of the CRCASM and that I. Management has no rights of access to the code of the buyer’s credit card.

Il suffit à l’acheteur d’indiquer  » paiement par chèque  » lors de sa commande en ligne puis d’envoyer son chèque à l’ordre de i.MANAGEMENT 80 rue Curial 75019 Paris en indiquant son numéro de commande. La commande est validée à partir du moment où le chèque est encaissé par la banque de i.Management.

The buyer simply has to indicate « payment by check » when ordering online, then to send his check payable to i. MANAGEMENT 80 rue Curial 75019 Paris by indicating the order number. The order is confirmed from the moment the check is cashed by the bank of i. Management.

> By bank transfer
The buyer simply has to indicate “Bank transfer » when ordering online, then transfer to the bank account of i. Management with for reference to the order number. The order is processed when the corresponding sum of money is credited to the account of i. Management. All bank charges are borne by the customer.

5. PRODUCT DELIVERY

Delivery deadline

For France, the delivery is made by Colissimo (delivery without signature of the recipient; 48 hour delivery subject to delays*).
The deliveries towards FRENCH OVERSEAS DEPARTMENTS AND TERRITORIES are made by Colissimo Overseas Export (72 hour delivery subject to delays*). The deliveries towards the European countries (see Secondary 1) are made by Colissimo Export International (48 hour delivery subject to delays*).

(*) the announced delivery deadlines are to be considered the date of the orders by i. Management, that same day for the orders validated before 12 am, and the next day otherwise. Orders are not shipped on weekends and holidays. The orders are not delivered on Saturday and Sundays.
The announced deadline does not take into account cases of force majeure which can prevent the delivery in the times (bad weather, momentary break, delay by customs for foreign and overseas territories), nor from problems attributable to the carrier, nor those due to the mistake of the buyer (incorrect or incomplete address). All claims must be received within ten days from the date of confirmation of the order.
If your country does not appear in the list (see SHIPPING & RETURNS page), please consult us for the shipping charges.
i. Management gives to the buyer a tracking number when the order is shipped and the buyer can track the shipment any time through Colissimo. When the article is available it will be sent within one business day after receipt of your order and payment. If the product is not available, the customer is notified as soon as possible by e-mail or telephone of the estimated delivery date.

For certain destinations, i. Management can use other shipping companies other than Colissimo to deliver the package. i.Management will communicate to the buyer the information needed to track the package.

6. RIGHTS OF WITHDRAWAL

The buyer can exercise his right of withdrawal in accordance with article L 121-20 of the Code of Consumption within 7 days of receipt of goods.
Products must be in original condition and packaging, unused and returned by Colissimo at your expense within 7 days after your delivery.
No returns will be accepted after this period of 7 days. Only unopened products will be refunded.
Please indicate at the back of the invoice originally included in your package your reason of withdrawal. We also do not accept parcels without any of your identification details (Order number, name, address).
Pack the items with care and send them by colissimo (mandatory) to:

Please allow 30 working days for processing your return. Refunds will be made either:

  • By a check corresponding to the amount of the product(s) purchased and sent to the billing address indicated in the order form;
  • To the credit card used during the order.

The sender will take responsibility of the costs and risks associated with returning the product. The refund does not include shipping costs.
In the event that shipping cost is levied, the fixed amount of postage will be retained. This amount is the rate in effect on the date of the order.

However, the right of withdrawal mentioned above is not applicable on sales outside the jurisdiction of the website of i. Management.
No withdrawal period is accepted in case of direct purchase from i. Management, such as in stores on its premises or any other premises designated on the booths of i. Management or all other booths in fairs and exhibitions.

The product will be directly delivered to the buyer.
It may also be delivered to the buyer after direct sales and the abovementioned sale sites.
Any sale is deemed final.
No withdrawal period is allowed.

7. Warranty

General guarantee

No commercial guarantee other than the legal guarantees (articles L 211-1 in L 211-18 of the Code of the consumption, protected from the defects and hidden planned by the civil code) is given by i. Management.
It is up to the customer to verify the goods at the time of their delivery. In case of damage or of absent person, of complaint on the visible defects or on the non-compliance of one or several delivered products, the customer will emit clear and precise reserves.
It will be up to the customer to supply any justification as for the reality of the noticed anomalies.

Any reserves or complaints must be sent to i. Management within the time limit in the article L 133-3 of the commercial law. The customer has a deadline of 3 days as from the delivery to send his protests. Any complaint must be formulated by writing at the following address:

Toute garantie est notamment exclue, en cas de mode de conservation des produits chez le consommateur impropre à leur nature ou d’utilisation dans des conditions anormales ou non conformes avec la nature, les prescriptions, l’aptitude à l’emploi du ou des produits.

Any guarantee is excluded in case of defects and deteriorations resulting from outer events, from accidents, from sabotages, or from any event presenting the characteristics of the force majeure.
Any guarantee is excluded in particular, in case of mode of preservation of products at the consumer unfit for their nature or of use in abnormal or not corresponding conditions with the nature, the prescriptions, the capacity in the use of one or several products.

8. RETURNS - EXCHANGES - REFUNDS

Conditions

Apart from the right of withdrawal and the legal safeguards mentioned above, any product returned shall be subject to the prior approval of i. Management and to meet the required conditions. Without prior agreement and/or compliance with the conditions of return, any package will be refused by i. Management and shipped back at the sender’s expense.
Concerning the exchange of products, your returns may be sent at your expenses up to 7 days after your delivery. The cost of reshipping is fixed and varies according to the country of the recipient. We will reship the exchange the day after the receipt at our premises.
No exchange will be accepted after this period of 7 days. We do not accept opened boxes.

2 / Returned and unclaimed package

Parcel unclaimed by customers are returned to i. Management by the shipping company after a fortnight at the post office. i. Management will then send a message to the customer to informing the return of the parcel. The return costs of the parcel is borne by the customer and corresponds to the costs incurred by i. Management.

9. OUT OF STOCK PRODUCTS

In case of unavailability of the product ordered, the buyer will be informed as soon as possible by telephone or e-mail of this unavailability. I. Management will offer the full refund of the sums paid within 30 days of the notification of unavailability of the product, unless the customer agrees to wait for the product to be restocked and have a longer delivery time under the conditions of paragraph 5 above.

10. CANCELLATION CLAUSE

In case of default of payment and 48 hours after a notice has been given, the sale will be automatically cancelled by i. Management who may request an interim return of products without prejudice to any other damages. Remaining costs for other deliveries will become immediately due if i. Management does not opt for the resolution of the corresponding orders.

11. RESERVATION OF OWNERSHIP

The sold goods remain under the ownership of i. Management until complete payment has been paid. However, the risk related to the goods will be transferred to the buyer or  the carrier, from the moment of physical delivery of the products.

12. ACCESS TO THIRD PARTY ITEMS BY THE WEB SITE OF I.MANAGEMENT

Sites outside i.Management that contain a hyperlink to this site are not under the control of i. Management thus i.Management will not be responsible for their contents. These links do not constitute, in any way, an endorsement or a partnership between i. Management and these sites, which are subjected to their own terms of use and privacy policies.
The buyer is thus informed and aware that the website of i. Management may contain information and/or items not belonging to i. Management and/or is not under its control. Therefore, the buyer acknowledges that i. Management will not be held liable, and will not be considered as an accreditation of any information, any element or content owned by third parties, which the buyer could access through the website of i. Management or by through a link on this site.

13. PERSONAL DATAS

The www.skeenpatch.eu site complies with privacy protection laws. According to the law No. 78-17 of January 6th, 1978 relating to data, files and freedom, you have a right to access, modify, rectify and delete data concerning you. To exercise this right, write to us at:

I. Management agrees not to disclose to third parties any personal information provided by you. They will be used by its internal departments for processing your order and to customize and enhance communication as part of customizing the site.
i. Management does not sell, rent nor reveal to third parties the information about its customers. It may decide to do so in future with suppliers or providers of i. Management for the direct and related needs for the execution of the sale contracts it enters to with its customers. i.Management will inform customers in advance in case the customer refuses to allow it.
Further, while navigating the site, according to the pages of interest to the user, it may be required to provide information to reveal his state of health.
As far as the health data have a direct nature or indirectly nominative, whether they are communicated by the Internet user and/or by a healthcare professional, the latter are subject to commercial use and are transmitted to anyone for commercial purposes or marketing by i. Management.

14. USE AND ACCESS TO THE WEBSITE

Items, information and services which the buyer accesses, downloads, uses and which are offered or sold by i. Management are provided « as is” and without warranty of any kind, and the legal provisions are applicable to the subject matter.
Management signs no commitment or guarantee of any kind whatsoever, express or implied, as to the proper operation of the site and its content.
I. Management disclaims all liability for damages which can arise from virus or other data due to problems arising from access to its services the download or use of these, including but in a not limited to direct and indirect damages.
i. Management reserves the right to modify, terminate, suspend or discontinue at any time, for any reason and in its discretion, access to all or part of the site, including but not limited to the content, featurues or operating hours without notice.

16. APPLICABLE LAW AND JURISDICTION

For the buyers based in France, this contract will be subject to French law and legal rules on territorial jurisdiction or allocation will apply.
For the buyers located in the European Union, the contract will be subject to French law, unless the contract was preceded by advertising or by an invitation specially made by i. Management in the country of the consumer. The competent court shall be determined according to the provisions of the EC Regulation No 44/2001 of 22 December 2000.
For consumers in other countries: except for other vital provisions, the contract will be governed by French law and any dispute arising from this contract will be subject to the exclusive jurisdiction of the French courts.
